Resolution #1 - PEC President Age Limit

Subject: PEC President Age Limit

WHEREAS, the Book of Order stipulates that a person can not be elected President of the Provincial Elders' Conference after his or her 65th birthday; and,

WHEREAS, healthcare has improved since this provision was enacted with resulting improved health in the years beyond age sixty-five; and,

WHEREAS, the years of experience in church leadership which one accumulates over a lifetime can be a vital asset in provincial leadership, especially in the office of President of the Provincial Elders' Conference; and,

WHEREAS, the age for full Social Security retirement benefits continues to increase beyond the age of 65 depending on the date of birth of an individual; and,

WHEREAS, this age limit for election can potentially result in great hardship for a sitting president who has reached the age of 65 when a Synod convenes but has not reached the age at which full retirement benefits are granted; therefore be it

RESOLVED, That Article VII, Paragraph 2 of the Rules and Regulations of the Southern Province be amended by deleting the second sentence: No person may be elected President after reaching the age of sixty-five; and,

RESOLVED, That this change not apply to the current President who has served during the quadrennium preceding the 2010 Synod.


Resolution #2 - Constitution Amendment (Deleting PFB)

Subject: Constitution Amendment (Deleting PFB)

WHEREAS, the 2006 Synod recognized that as a province that seeks to be faithful in its discipleship, we are called to greater efforts toward realizing our potential, thereby making our ministries more available and active; and,

WHEREAS, the 2006 Synod recognized a desire to improve communications, polity, unity and community building, as well as discover how we might better organize ourselves for the service of Christ; and,

WHEREAS, Resolution 55 of the 2006 Synod directed the PEC to appoint an impartial task force charged with systematically and critically examining all aspects of our provincial administration and ministries, including PEC, boards and agencies and their relationships with local congregations; and,

WHEREAS, pursuant to the direction of the 2006 Synod, the PEC appointed the Task Force on Provincial Administration/Ministries; and,

WHEREAS, the Task Force met periodically, examined matters within its charge and reported its findings to the PEC; and,

WHEREAS, PEC called for a Special Synod in 2009 for the purpose of considering the recommendations of the Task Force; and,

WHEREAS, the Special Synod of 2009 amended the Rules and Regulations of the Moravian Church in America, Southern Province to conform to the Reorganization Plan, all as set forth in the Restated Rules and Regulations; and,

WHEREAS, a Steering Committee was formed by the Special Synod of 2009 and PEC to effect the implementation of the Reorganization Plan and make such provision for transition issues as may come before it, including, but not limited to, appropriate revisions to the Book of Order, and,

WHEREAS. the Special Synod of 2009 resolved to recommend to the Synod of 2010 that The Constitution of the Moravian Church, Southern Province be amended to conform to the Reorganization Plan; therefore be it

RESOLVED, That The Constitution of the Moravian Church in America, Southern Province, be amended by deleting Article I, Section 4. Duties and Functions of the Provincial Synod and substituting in lieu thereof the following:

Article I, Section 4. Duties and Functions of the Provincial Synod

The Provincial Synod shall have power:

  1. to carry out the principles of the Moravian Church (Unitas Fratrum) laid down by the Unity Synod for constitution, doctrine, worship and congregational life;
  2. to examine and oversee the spiritual and temporal affairs of the Province and its congregations;
  3. to legislate in regard to constitution, worship and congregational life for the Province;
  4. to provide the vision, direction and expectations for Provincial mission and ministry and to review the results thereof;
  5. to elect the Provincial Elders' Conference which shall constitute the administrative board of the Province and which shall be responsible to the Synod for the management of the affairs committed to it;
  6. to elect representatives to inter-provincial agencies, boards and such other entities as it deems appropriate;
  7. to elect Bishops;
  8. to elect Delegates to Unity Synod;
  9. to act as the final court of appeal to hear and redress grievances; and,
  10. to perform such other acts as shall be designated to it by the Rules and Regulations and such other acts as shall be lawful under its Articles of Incorporation.

Resolution #3 - Constitution Amendment (Deleting PFB)

WHEREAS, in the course of its work on reorganization, the Task Force on Provincial Administration/Ministries appointed by the PEC following the 2006 Synod determined that amendments to The Constitution of the Moravian Church in America, Southern Province, can only be made at a "stated" Synod; and,

WHEREAS, the Task Force recognized that such a provision unduly restricts the work of the Moravian Church and could work to unduly hinder and delay needed changes in the polity of the Moravian Church; and,

WHEREAS, the Special Synod of 2009 approved the Reorganization Plan submitted by the Task Force and recommended that The Constitution of the Moravian Church, Southern Province be amended so as to authorize any duly convened synod to amend the Constitution according to provisions for amendment as contained in the Constitution; therefore be it

RESOLVED, That The Constitution of the Moravian Church in America, Southern Province, be amended by deleting the word "stated" in I CONSTITUTION, Section 6. Amendments.

Resolution #4 - Conferential Government

Subject: Conferential Government

WHEREAS, the Synod of 2006 instructed the PEC to "draft a statement defining conferential government to be submitted to the Southern Province at the next synod and if adopted submitted to the Unity Board for approval"; and,

WHEREAS, the Moravian Church in America, Southern Province is unique among the provinces of the Unity in using the term "conferential" to describe its provincial government; and,

WHEREAS, the polity and "conferential" government of the Southern Province conforms in every respect to that required by the Church Order of the Unitas Fratrum and thus does not need further approval by the Unity Board; therefore be it

RESOLVED, That the following statement on "conferential" government, prepared by the PEC and adopted by the PEC on August 7, 2007 as a working definition, be approved by the 2010 Synod and submitted to the Unity Board for information:

Background:

According to Bishops Taylor and Kenneth Hamilton, the "conferential principle" has characterized Moravian Church government since its "earliest days". (see History of the Moravian Church 1722-1957 by Hamilton and Hamilton, 1967, pages 94ff, 111-112) The conferential principle was suspended during the decade following the Synod of Hirschberg in 1743 (a Synod that presented Count Zinzendorf "with a formal document that assured him of unlimited powers of management and oversight, as Advocatus et Ordinarius Fratrum, acknowledging his right of veto in all church matters, without his being responsible for his actions to any Synod or conference.") ( Hamilton, p.97). By the mid 1750's, however, the "conferential principle" was reaffirmed and reinstated, although Zinzendorf continued to exercise primary influence in the governance of the church until his death in 1760.

In the following definition, "conferential principle" and "conferential government" are assumed to be one and the same, and the terms are used interchangeably.

Definition:

The term "conferential government" is a term commonly used today in the Southern Province of the Moravian Church in North America to describe our form of church government, although it is not a term commonly used in other provinces of the Unity.

Strictly speaking, "conferential government" means that governance responsibility and authority in the church is vested in "conferences" (groups or boards) charged with governance under the guidance of Jesus Christ, the Chief Elder of the Moravian Church, as opposed to being vested in individual officers (e.g. bishops). It is thus imperative that such "conferences" seek the will of Christ in all matters. The ultimate "conference" in the Moravian Church is the Unity Synod, and in any given Province, the Provincial Synod. Between meetings of a Provincial Synod, governance within a Province is vested in a Provincial Elders' Conference (or Provincial Board). Again, strictly speaking, "conferential government" from the perspective of the worldwide Unity does not imply any particular provincial structure, other than the investment of authority in Synod and a Provincial Board. For example, although in the Southern Province the call system currently in place is sometimes used as an example of "conferential government" in action, other Provinces of the Unity, which are also governed by the "conferential principle", utilize a call system for pastors that is far less collaborative than that of the Southern Province and is more aptly described as an appointment system for placement of pastors in congregations, with the Provincial Board making the appointment. (Thus, it is probably best not to use the call system in the Southern Province as an example of "conferential government"; rather, the call system in the Southern Province is an example of collaborative administration on the part of the PEC.)

Likewise, "conferential government" means that governance authority in the local congregation is also vested in boards rather than individuals. Through Congregational Council and Boards of Elders and Trustees (or in some cases a unified Church Board), the "conferential principle" is implemented rather than authority being vested solely in the Pastor, although the Pastor is expected to provide spiritual guidance and leadership. And, as a matter of practice, the PEC relates primarily to congregational boards (rather than to individual members) on congregational matters; thus, provincial "conference" relates to congregational "conference".

Having noted that conferential government in the Unity refers only to the "conference" which exercises authority, the Southern Province has deemed it wise, as a result of experience and discernment of the leading of the Holy Spirit, to govern itself as collaboratively as possible among congregational boards, pastors and PEC. The degree of collaboration has varied historically over the past century or more, but the Southern Province has experienced the value of working together - PEC, pastors and congregational boards - as collaboratively as feasible, while recognizing that final authority and governance responsibility in the Province rest with the Provincial Synod and with the PEC between meetings of Provincial Synod.

"Conferential government" is neither "congregational government" under which each congregation is autonomous, nor "episcopal government" which places the church under the direction of a bishop or other judicatory head, nor "governance by consensus". It is governance by "conferences" of elected persons, rather than a single individual, instructed to make decisions for the good of the whole church and its mission under the guidance of the Holy Spirit. As such, the "conferential principle" has served our church well throughout its long history.

Resolution #5 - Presbyterian Church USA Covenant Partnership

WHEREAS, on the night before his death our Lord prayed three times that his followers would be one, affirming that such oneness affects the successful spread of the Gospel ("so that the world may believe that you have sent me" and "so that the world may know that you have sent me and have loved them even as you have loved me"); and,

WHEREAS, the purpose from the beginning of our dialogue with the Presbyterians was clearly stated and remains that together we might work to further the witness and mission of Christ's Church; and,

WHEREAS, our ancestors in the Unitas Fratrum put forth persistent efforts toward the unity of Christians; and, for their great bishop, John Amos Comenius, reunification of the church was part of the work of Christ, who cannot be divided, and must be a part of the mission of the community of faith; and,

WHEREAS, Count Nicholas Ludwig von Zinzendorf, leader of the Moravians who settled on his estate, was such a force for Christian unity that he has been called "the Ecumenical Pioneer," and the Moravian Church that emerged has continued to pursue this goal, maintaining close relationships with other communions, especially with Lutherans, Anglicans, and Reformed/Presbyterians, and,

WHEREAS, The Ground of the Unity declares that "it is the Lord's will that Christendom should give evidence of and seek unity in Him with zeal and love," and "in our own midst we see how such unity has been promised us and laid upon us as a charge," and "we welcome every step that brings us nearer the goal of unity in Him" (Par. 6); and,

WHEREAS, our church and the PCUSA have cooperated in Christian Education, including publishing many Christian education resources together and using them in both of our churches since the 1950's; and,

WHEREAS, some of our Christian educators have been schooled at the Presbyterian School for Christian Education in Richmond, Virginia; and,

WHEREAS, the Provincial Elders' Conferences and Conference of Bishops of the Northern and Southern Provinces and the Commission on Unity and Ecumenical Affairs of the Southern Province have taken action supporting adoption of the proposal developed for establishing a relationship of covenant partnership between our provinces and the Presbyterian Church USA; therefore be it

RESOLVED, That the 2010 Synod of the Moravian Church in America, Southern Province, enter into a relationship of covenant partnership with the Presbyterian Church USA by adopting An Invitation to the Table: Moravian/Presbyterian Covenant Partnership.

RESOLVED, That the 2010 Synod of the Moravian Church in America, Southern Province, enter into a relationship of full communion with The Episcopal Church by adopting Finding Our Delight in the Lord: A Proposal for Full Communion Between The Episcopal Church; the Moravian Church-Northern Province; and the Moravian Church-Southern Province.

Resolution #7 - Provincial Women's Board Membership

Subject: Provincial Women's Board Membership

WHEREAS, The Book of Order states that the Provincial Women's Board shall consist of ten members elected by Synod for a term of four years subject to re-election for a second term of four years and eight persons appointed to serve a term of four years subject to re-appointment for a second term of four years with all the rights and privileges enjoyed by members elected by Synod; and,

WHEREAS, the Provincial Women's Board of the Southern Province has operated with 16 members either elected at Synod or appointed over the past 5 years; and,

WHEREAS, the Provincial Women's Board has had a female clergy representative as one of its members over the past 6 years; therefore be it

RESOLVED, That the Provincial Women's Board be permanently made up of 17 members, plus one paid non-voting Administrative Assistant/Bookkeeper. Ten members will continue to be elected by Synod and six to be appointed by the Provincial Women's Board. The seventeenth member of the board will be a female clergy member appointed by the board to serve a two-year term with the option to be re-appointed for another two-year term.

Resolution #8 - Sabbatical Proposal - Book of Order Change

WHEREAS, the Synod of 2006 resolved that PEC, or a body commissioned by the PEC, should examine the wording in Paragraph 858, Leaves of Absence, in the Book of Order, and develop language regarding the value and importance of sabbaticals for ordained pastors and certified directors of Christian education and bring proposed changes to the Synod of 2010; and,

WHEREAS, the Commission on Ordained Ministry developed "Sabbatical Guidelines" and submitted them to the PEC for review and reaction; and;

WHEREAS, in April 2009 the PEC approved "Sabbatical Guidelines" for use by congregations, pastors and directors of Christian education; therefore be it

RESOLVED, That, a new section, Sabbaticals, be added to Book of Order, Paragraph 858, to read as follows:

Sabbaticals for Ordained Pastors and Certified Directors of Christian Education

  1. Guidelines for sabbaticals have been established by the PEC and may be accessed on the Southern Province website or from the PEC Office.
  2. PEC will emphasize the value and importance of sabbaticals as part of congregational review.
  3. For congregations which are unable to provide the financial support needed for funding a sabbatical, the PEC will provide a current list of potential sources of funding.
  4. The salary, benefits, and credit toward years of service will continue while a pastor or DCE is on sabbatical.
  5. PEC will supervise or designate a committee to work with those individuals interested in applying for a sabbatical.
  6. The "Sabbatical Guidelines" approved April 21, 2009, by PEC shall be reviewed and revised by PEC as needed and communicated to all pastors, directors of Christian education, and congregations;

RESOLVED, That the Book of Order, amended Paragraph 858 will be outlined as follows:

858. Leaves of Absence and/or Withdrawal from the Ministry

Sabbatical Guidelines
in the Southern Province
of the Moravian Church in America

The process for taking a sabbatical begins with a request from a pastor to the Provincial Elders' Conference for approval and to establish procedures and provisions for the sabbatical. With approval from the Provincial Elders, the minister may then proceed to the local Board(s) with the PEC's full support.

The Provincial Elders' Conference will recommend and encourage sabbaticals as part of call processes and conferences with boards. The PEC will work with the local Board (s) to enable the congregation to continue to function effectively during the minister's sabbatical. Triennial Reviews will also address the issue of sabbaticals.

Sabbaticals are recommended and encouraged every seven years; however, the minister should have served in the current position for a minimum of six years without any leave time other than vacation. The suggested length of a sabbatical is six weeks to three months. It is also recommended that planning for a sabbatical begin at least six months in advance to allow adequate preparation of the plan for the pastor and the congregation.

Sabbatical plans should include the following three components:

  1. Study/Outline a project or subject of study and how to accomplish;
  2. Reflection Activity/Retreat at a retreat center or reflective reading and reflection on spiritual writings with a written record of the outcomes;
  3. Recreation/relaxation with family and friends.

Sabbatical plans should also include:

  1. Provisions about how the pastor's responsibilities for the congregation or agency will be supplied;
  2. Information about how the sabbatical will benefit the local congregation or agency and the wider church;
  3. How the minister will report back to the PEC and the local congregation or agency about the successes and challenges of the sabbatical.

The minister's being away from the congregation or agency and locale, both physically and professionally, is strongly advised. If the minister chooses to stay in town, explicit boundaries should be set with respect to the ministers going to the church or office and parishioners or office contacts with the minister. Congregation members and office staff should understand clearly the boundaries of the sabbatical time and that it is inappropriate for them to contact the minister during this time. This should be clearly negotiated before the sabbatical begins. Phone calls and expectations that the minister will attend church functions or visit the office should be avoided. The sabbatical should have a flow that should not be broken by such interruptions. Special events in the life of the church or agency should be scheduled around the sabbatical. Responsibilities should be clearly delegated and provisions made for such events. Any relevant information should be left for reference by the responsible parties. This is a part of the sabbatical planning.

Sabbatical time should be taken as a whole and not be divided into several parts. Although sabbaticals may be taken in conjunction with or separately from vacation time, sabbatical time should be considered as separate and distinct from vacation time.

Although the minister may need to stay in touch with the supply minister or agency office about certain matters, there should not be a regular check-in or a return to regular duties during this time. Adequate coverage for emergencies and special concerns should be worked out prior to the beginning of the sabbatical.

Plans for staying in touch with other ministerial colleagues for spiritual companionship, accountability and nurture may be advisable. Groups such as Sustaining Our Shepherds may be helpful at this time.

Coverage of worship leadership, pastoral care and all other responsibilities should be funded as mutually agreed upon by the local congregation or agency and the PEC.

Upon the return of the minister, there should be a Board meeting to re-establish the relationship between the minister and the church or agency. The minister should report in writing on the benefits of the sabbatical, growth or changes in his/her person, and what rejuvenated or refreshed the minister for service. The Board(s) should apprise the minister of any happenings of importance in the church or agency; discuss what might have been done better in advance planning to prepare the congregation or agency and share results with PEC; and, discuss what the congregation or agency learned about the functioning of the minister that was significant. A reception or service of some sort should be planned to send off the minister and also to welcome the minister back and to give the minister the opportunity to thank those who made the sabbatical possible.

A period of re-entry should be planned in order to re-establish the minister's role. When the sabbatical works well, there is an empowering experience for the congregation or agency which has functioned well during the sabbatical.


Resolution #10 - Clergy Compensation and Benefits

WHEREAS, it has been the practice of Synod to approve a compensation and benefits plan for the succeeding intersynodal period; and,

WHEREAS, predicting the future economic state and legislative requirements has become more difficult; making four year compensation and benefit commitments is no longer prudent; therefore, be it

RESOLVED, That minimum salary guidelines for 2011 be:

RESOLVED, That PEC be given the authority to make decisions with regard to all compensation and benefit matters such as minimum salary ranges, housing allowance, housing equity allowance, and all other group and supplemental plans after consultation with Provincial Support Services. This would begin with 2012 - 2014; and,

RESOLVED, That a Human Resource Administrative Manual be created and administered under the authority of the PEC.

Resolution #14 - Cornerstone Campaign for New Churches

Subject: Cornerstone Campaign for New Churches

WHEREAS, the Cornerstone Campaign was established by the Synod of 1986, and continued by the Synods of 1992, 1995, 1998, 2002, and 2006; and,

WHEREAS, this program has raised over $1.6 million dollars, greatly assisting new congregations in the purchase, construction or renovation of church facilities from which to conduct their ministry, witness and service; and

WHEREAS, funds raised by the Cornerstone Campaign remain an essential part of the funding of facilities for new congregations; therefore be it

RESOLVED, That the Cornerstone Campaign be continued for the next inter-Synodal period (2010-2014); and,

RESOLVED, That the campaign be funded from our congregations at an annual level determined by the Provincial Elders' Conference; and,

RESOLVED, That the Cornerstone Campaign be considered a special Benevolent Capital and Outreach Program for the above stated period and thus excluded from the determination of the formula percentage for Provincial contributions; and,

RESOLVED, That the Provincial Elders' Conference choose a Sunday each year as a time to fully inform our congregations about this campaign, preparing and distributing materials for that purpose; and,

RESOLVED, That Church Board(s) of our congregations review and consider their participation in this program each year before preparing their annual budgets.

WHEREAS, for 50 years Laurel Ridge has offered individuals, families, churches, and other groups an incredible mountain location for relaxation, recreation, spiritual growth, reflection, and renewal with the mission of being a mountain place set apart for forming disciples of Jesus Christ who live and learn in community to serve in the world; and,

WHEREAS, in 1993 and 1994 the Laurel Ridge Board created the Laurel Ridge Master Plan to help guide the values and growth of the camp that led to a request by Laurel Ridge to the Synod of 1995 for a Capital Campaign, "Through all Generations," which was not successful enough to allow Laurel Ridge to do all the work needed. This campaign included the new Activities Center, the dam repair, along with other needs; and,

WHEREAS, the Synod of 2002 passed Resolution #39, "The Continuing Work of the Board of Directors of Laurel Ridge Moravian Camp, Conference and Retreat Center", in which the Resolve read, "That the 2002 Synod of the Moravian Church, Southern Province, commend the work of the Laurel Ridge Board on behalf of the province and support its continuing efforts to strengthen and grow the ministries and facilities of Laurel Ridge as it serves our province in the years ahead." This resolution was submitted in order to facilitate the completion of the efforts undertaken through the 1995 resolution (based on the board adopted Laurel Ridge Master Plan from 1994), specifically the expansion of Higgins Lodge; and;

WHEREAS, along with the submission of the resolution at the 2002 Synod was the Laurel Ridge Board's presentation to the Provincial Financial Board regarding another capital campaign, "Growing for a Lifetime", to complete the Higgins Lodge expansion. This campaign was delayed two years due to the economy; and;

WHEREAS, because of unforeseen issues with the septic and water systems on the ridge, the need to stage the new work by having the new kitchen at Higgins Lodge completed first, and other delays in getting the Higgins work started while construction costs were on the rise, the campaign total of just over $2,000,000, while in excess of the campaign goal, was not sufficient to cover the total construction cost. The Laurel Ridge Board then worked with the Provincial Financial Board to get a loan to complete the Higgins Lodge expansion, resulting in a debt load of about $1,400,000 (a 30 year mortgage with a monthly payment of $10,000); and;

WHEREAS, after 50 years, the Summer Camp Kitchen now requires a major renovation to meet new North Carolina Health Code laws or the kitchen will be shut down in May 2012; and;

WHEREAS, the Laurel Ridge Board has recently updated the Facility Plan section of the Laurel Ridge Master Plan to reflect completed projects, projects that have been omitted for good cause, and needed future projects (see the report in the Synod Delegate package); and,

WHEREAS, the Laurel Ridge Board has developed a Five Year Fund Development Plan with a goal of raising $3,000,000 with the following components: Top of the Mountain Circle annual fund with a goal of $50,000 for 5 five years for a total of $250,000; Planned Giving and Endowment goal of $250,000; Capital Projects goal of $2,500,000 including an Operating Reserve of $100,000; therefore be it

RESOLVED, That the Laurel Ridge Board of Directors, in consultation with the PEC and the Moravian Ministries Foundation be allowed to establish and execute a Capital Campaign with a goal of $900,000 to fund the Summer Camp Kitchen renovations and reduce the Higgins Lodge debt; and;

RESOLVED, That the first monies collected will be used for the Summer Camp Kitchen to prevent any additional debt for the camp.

Resolution #18 - Laurel Ridge - Limited Liability Corporation (LLC)

WHEREAS, the 2009 Special Synod approved a new provincial organization which temporarily placed the Boards of Laurel Ridge and Sunnyside Ministry directly under the oversight of the Provincial Elders' Conference; and,

WHEREAS, the PEC appointed a committee to study and recommend the most appropriate placement of Laurel Ridge and Sunnyside in the new provincial structure; and,

WHEREAS, the study committee has recommended that both Laurel Ridge and Sunnyside Ministry function organizationally under the Board of Cooperative Ministries, while maintaining the Laurel Ridge Board of Directors and the Sunnyside Program Committee for purposes of ongoing oversight and supervision; and,

WHEREAS, the study committee also recommended that the Province investigate the possible advantages of forming a Limited Liability Corporation (LLC) to hold title to Laurel Ridge property and assume liability for operations; and,

WHEREAS, the formation of an LLC would not constitute a separation of Laurel Ridge from the Province, but would provide a degree of legal protection against potential liability claims upon the Province; therefore be it

RESOLVED, That the Synod of 2010 authorizes the PEC to conduct a thorough assessment of the feasibility and desirability of forming a Laurel Ridge LLC; and,

RESOLVED, That the Synod of 2010 authorizes the PEC to implement the formation of a Laurel Ridge LLC if the PEC deems such to be advisable after consultation with legal and financial expertise.

WHEREAS, the Church Order of the Unitas Fratrum requires that the Southern Province, Moravian Church in America, have a "Provincial Church Order" appropriate to its work and in agreement with the Church Order of the Unitas Fratrum; and,

WHEREAS, a review of the current Book of Order of the Southern Province, Moravian Church in America, reveals an organization and content that is difficult to administer due to a intermixing of Unity and Provincial documentation, the incorporation of administrative procedures with regulations, and the lack of clearly organized principles, standards and regulations for the Province; and,

WHEREAS, the Special Synod of 2009 resolved to reorganize the Southern Province, Moravian Church in America, resulting in the need for significant changes to the existing Book of Order; and,

WHEREAS, the Synod of 2010 will be developing vision and direction for the Province which will impact the future principles and standards that may need to be incorporated in the Book of Order; therefore be it

RESOLVED, That the following definitions shall apply in revising and maintaining the Book of Order and in conducting the work of the Province:

RESOLVED, That the section, Church Order of the Unitas Fratrum, shall contain an exact copy as published after each Unity Synod, shall be used as the official reference and standard for Provincial action, ministry and mission, shall not be subject to Provincial Synod approval, and shall be updated at the conclusion of each Unity Synod by direction of the PEC; and,

RESOLVED, That the section, Church Order of the Southern Province, shall only contain the principles, standards, and regulations needed to carry out the ministry, mission and polity of the Southern Province, shall be subject to Provincial Synod approval, and shall be updated at the conclusion of each Provincial Synod by direction of the PEC; and,

RESOLVED, That as part of the revision of the Church Order of the Southern Province, the existing Constitution and Rules and Regulations of the Moravian Church in America, Southern Province, shall be combined into one document to be called Constitution of the Moravian Church in America, Southern Province; and,

RESOLVED, That revisions to the Moravian Covenant for Christian Living shall be subject to joint approval by the Northern and Southern Provinces; and,

RESOLVED, That policies and procedures necessary to carry out the ministry, mission and polity of the Southern Province as directed by the Church Order of the Southern Province shall not be included in the Provincial Book of Order, shall be developed (with appropriate PEC review and approval) by the provincial entity responsible for carrying out a requirement, and shall be indexed in the Provincial Book of Order; and,

RESOLVED, That the Provincial Elders' Conference shall coordinate the revision of the Book of Order and shall provide the revision for review and appropriate action at the Synod of 2014.

Resolution #20 - DCE Benefits and Compensation Guidelines

WHEREAS, the Synod of 1998 instructed the Provincial Elders' Conference, in consultation with the Board of Christian Education, to develop guidelines for standardized salary and benefits packages for full time professional church educators serving in the Southern Province; and,

WHEREAS, the Synod of 1998 created the standing Compensation/Benefits Study Committee to work with the Provincial Elders' Conference to make recommendations for salary and benefits of clergy, educators and staff to subsequent synods; and,

WHEREAS, these guidelines for DCE benefits and compensation were created and approved by the Provincial Elders' Conference and the Provincial Synod of 2002 but have not been updated since 2002; and,

WHEREAS, in this past intersynodal period the Compensation/Benefits Study Committee, the Church Educators Committee of the Board of Christian Education, and the Provincial Elders' Conference have worked together to create, along with comparisons with other denominations (Attachment 1), updated "DCE Benefits and Compensation Guidelines" (Attachment 2) for use in our congregations employing professional church educators; therefore be it

RESOLVED, That the Synod of 2010 commend this work done on behalf of our professional educators serving in the province; and,

RESOLVED, That the Synod of 2010 receive and support the DCE Benefits and Compensation Guidelines (Attachment 2) approved by the Provincial Elders' Conference in May, 2010, and encourage their continued use during the intersynodal period between 2010 and 2014.

2010 DCE Benefits and Compensation Guidelines for
Full Time Directors of Christian Education (DCE)

1. Salary Guidelines: Minimum beginning salary of $28,000 annually for a full-time DCE with a college degree, or $30,000 with a Masters Degree in Christian Education, or $22,000 annually without a college degree. An annual increase of $500 for the first five years. Minimum percentage increase per year for the years following based on years of service and effective performance. Churches are encouraged to exceed this minimum base salary if possible. Automatic $1,200 salary increase in the year when a DCE achieves either status of provincial certification.

2. Benefits: Employee's health, dental, life and disability insurance should be provided by the church.

3. Vacation: Minimum of two weeks paid vacation annually with an increase to a minimum of three weeks annually after three years of full-time service as a DCE.

4. Travel Reimbursement: Expenses for official travel should be reimbursed at the prevailing mileage rate set by the IRS.

5. Continuing Education: One week paid annually for continuing education. Minimum of $500 recommended for annual allowance for continuing education cost.

6. Camping Ministry: One week annually to serve in the provincial camping ministry at Laurel Ridge.

7. Retirement: Minimum 5% annual retirement annuity based on the base salary, for investment in a retirement plan, with the option for additional employee contributions.

8. Intersynodal Reviews: DCEs will fully participate in the intersynodal review process carried out by the PEC with congregational boards between each provincial synod.

9. Annual Review: Appropriate board or designated body (i.e. personnel committee) of each congregation will engage in a review of the DCE's salary and benefits with the DCE annually.

10. Synod Delegate: As per action by the Synod of 1998, all certified, Moravian full time DCEs currently employed by congregations in the province are full delegates to synods and included in the official directory of the Moravian Church in America.

11. Provincial Review: The Provincial Elders' Conference will review these guidelines on an annual basis.

WHEREAS, the Moravian Church, Southern Province, has long affirmed that church educators and congregations are brought together through a call from God for the purpose of serving the ministry of Jesus Christ; and,

WHEREAS, "The title of Christian Educator is used to describe those persons who are called to serve Jesus Christ as educators in the Moravian Church and are employed for that purpose. The central meaning behind the title for this ministry is that the person is responsible for assisting a congregation or church agency in its mission purposes, educational programs and strategies. The Christian educator also provides leadership support and training, guidance with curriculum and resource needs, and program evaluations. Other areas of ministry may be part of this person's job description, depending on a person's individual skills or what the congregation calls upon this person to do." (Christian Education Manual Southern Province, 2008)

WHEREAS, the Moravian Church, Southern Province, has offered for over 30 years professional certification standards for church educators that have been administered by the Board of Christian Education and the Provincial Elders Conference; and,

WHEREAS, in the last intersynodal period the provincial Church Educator Committee and the Moravian Association of Church Educators (MACE) have been actively seeking ways to strengthen Christian Education ministry in the local church and support educators who are called to this ministry (See Attachment 1: Church Educators Serving Under Provincial Appointment); and,

WHEREAS, it will be important in the new provincial structure (with the absence of the Board of Christian Education) to provide intentional support, advocacy, recognition and professional accountability to the vocational ministry of Christian Education in the new structure; therefore be it

RESOLVED, That beginning in 2011 the Provincial Elders' Conference will work in consultation with local congregations currently employing church educators, full time or part time, to provide them provincial appointment in accordance with the guidelines in the provincial church educator manual currently approved by the PEC (October 2008); and,

RESOLVED, That PEC and local congregations will also work in consultation to see that church educators being employed by congregations in the future shall also be provided provincial appointment; and,

RESOLVED, That such provincial appointment shall be understood to provide empowerment and the blessing of the wider church, recognition of one's call and gifts for educational ministry, and mutual accountability for the educator, local congregation and the wider province.

RESOLVED, That the Provincial Elders' Conference, Board of Cooperative Ministries, and Moravian Association of Church Educators will continue to work together in the intersynodal period between 2010 and 2014 to encourage and affirm those called into the professional educational ministry of the church and to review the provincial church educator guidelines as well as the appointment process being provided under the new provincial structure.

Church Educators Serving Under Provincial Appointment

Churches today are calling for competent church educators to assist them as they respond to Christ's command to teach. They need educators who perceive working in educational ministry not as one job among many but as a call to ministry with the people of God. Call is the understanding and acceptance of one's purpose in God's plan. It is a relationship established not primarily for the benefit of one or both parties but for the purpose of service in the ministry of Jesus Christ. God has endowed both the educator and the people with particular gifts and experiences that, when brought together, provide the resources for effective ministry. The reality is that church educators come to their calling in a variety of ways and with various levels of educational preparation and experience. Some educators begin their journeys with college and/or graduate educational programs. Others come through the recognition of their gifts and commitment by members in congregations that have benefited from their lay leadership.

Our past experience in the Moravian Church, Southern Province has been that educators in congregations have been employed by a particular congregation. As part of the staff of that church they are part of the congregational reviews and triennial reviews conducted by the Provincial Elders Conference. These educators have received encouragement and support through the Provincial Board of Christian Education and in particular the Church Educator Committee called for by Synod and operated under the Board of Christian Education. When churches are interested in employing an educator, they can choose to go to the Board of Christian Education to find guidance in filling the position.

We have had as many as 25 educators serving in some capacity in congregations in the Southern Province. At present, there are eleven congregations or agencies employing full time positions in Christian Education, three part time positions, and we have three retired educators. Of our active educators, seven are currently certified. We have three retired certified educators and there are four educators who have been certified in the past but are not currently serving in churches. Two of these are now active pastors.

Our educators meet monthly in a support group called MACE - Moravian Association of Church Educators - as well as being a part of the Moravian Ministry Association. In 2007, MACE became a member in a national group of educators - the Association of Presbyterian Church Educators (APCE).

At this time, the Provincial Church Educator Committee would like to propose that the educators in the Southern Province come under appointment of the Provincial Elders Conference. The purpose of putting the educators under appointment would include:

Serving under appointment will not change the fact that the educator is employed by the individual congregation and supervised and responsible to church boards. It does provide a healthy, personal and professional connection between churches and the provincial structure.

The recommendation from the provincial Church Educator Committee to have professional church educators who are serving in local congregations to serve there under appointment by the Provincial Elders Conference offers important support, advocacy, recognition and professional accountability to the vocational ministry of Christian Education in our province. Four important elements of this appointment are listed below:

Standards - In the past the province has offered and encouraged a certification program which has been coordinated through the Board of Christian Education and has benefitted many educators and the ministry of Christian Education in many congregations. Serving under appointment by the PEC offers continuation of this style of credentialing and also affirms and expects an identified level of qualifications for educators which is consistent and measurable. It acknowledges as a denomination the important status of Christian Education in our church life and mission. And, along with the significance of both credentialing and vocational status, it holds educators to the important provincial expectations recognized in the Book of Order through such things as the document on Responsible Personal Behavior.

Practices - Serving under appointment to the PEC offers educators, congregations and the PEC a more consistent and understood mechanism for dealing with hiring practices and procedures, working with synod recommended guidelines on compensation and benefits for educators, providing for needed continuing education and professional enrichment, and working with congregations who have multiple staff situations on matters of developing and strengthening team ministry at the local level.

Evaluation - Church educators need and want professional evaluation. Currently some congregations employing educators do annual evaluation through a personnel committee, board, CE Committee, or other senior staff person. Some churches have no formal evaluation process. Serving under appointment offers congregations, educators and PEC the opportunity to develop and provide consistent and recognized evaluation practices. It will also serve to strengthen congregational feedback for educators along with the practice of PEC which includes educators in the triennial review of each congregation during an intersynodal period.

Communication and Consultation - While the Board of Christian Education has been able to maintain informational files on church educators in the past at their request, there is no consistent personnel information on educators at a provincial level. Serving under appointment provides PEC the opportunity to keep such personnel files that will be useful for congregations, educators and the PEC in record keeping, personal and professional achievements, potential hiring needs, and HR functions. It would include educators in the annual church reporting that goes to PEC from clergy, and it could keep records on continuing education as well as its funding support from provincial sources. Serving under appointment also raises the on-going need for the PEC to recognize and affirm the gifts of persons who demonstrate a vocational call to pursue service in Christian Education ministry in our congregations. This has recognized procedures for ordained clergy, but needs newly developed and recognized ones for potential new educators.

Resolution #22 - United Methodist Church Bilateral Dialogue

WHEREAS, the Council of Bishops of The United Methodist Church has expressed the interest in that communion entering into dialogue with the Moravian Church with the intent of pursuing a relationship of full communion; and,

WHEREAS, the General Commission on Christian Unity and Interreligious Concerns of The United Methodist Church in addressing its goal - "The unity of Christ's church will be made more visible through Full Communion agreements, Interim Eucharistic Sharing, bilateral dialogues, and shared congregations." - included the objective of beginning "a bilateral dialogue with the Moravian Church in North America" within the current 2008-2012 quadrennium; and,

WHEREAS, United Methodists and Moravians have sustained a long-lasting, cordial, and cooperative relationship; and,

WHEREAS, the Synod of the Moravian Church, Northern Province, meeting in June 2010 approved the initiation of a bilateral dialogue with the United Methodist Church within the next intersynodal period; therefore be it

RESOLVED, That the Provincial Elders' Conference of the Moravian Church, Southern Province shall initiate a bilateral dialogue with The United Methodist Church within the next intersynodal period (2010 - 2014). This bilateral dialogue shall have the objective of negotiating a formal relationship of full communion as understood in the definition of full communion contained in the report of the Unity and Ecumenical Affairs Commission of the Southern Province submitted to the 2002 Synod (Resolutions, Reports and Elections, Provincial Synod, April 17-21, 2002, p.17-18).

WHEREAS, the issue of homosexuality has been the focal point of much conflict and division in many American churches for the past two decades; and,

WHEREAS, the lack of open and respectful discussion of this issue has caused confusion; and,

WHEREAS, the 1995 Synod of the Southern Province resolved that the church should not condone discrimination against homosexuals; and,

WHEREAS, the Northern Province has addressed the issue of full participation of homosexuals in the church at several synods beginning in 1974 and most recently in 2010; therefore be it

RESOLVED, That the 2010 Synod of the Southern Province reaffirm the resolution of the 2002 Unity Synod (RESOLUTION 885) "that the church should not make a hasty decision at this time, but urges the provinces towards further, in-depth examination of the subject of homosexuality and the church;" and,

RESOLVED, That the Southern Province begin a careful process of study and discernment regarding homosexuals in the church in preparation for the 2014 Synod; and,

RESOLVED, That PEC appoint a task force with a balanced representation of differing views to lead this process of study and discernment, that includes opportunity for members of the Southern Province to discuss this issue openly and honestly; and,

RESOLVED, That accurate information on homosexuality, Moravian doctrine, biblical interpretation and authority, and sexual ethics be provided to congregations; and,

RESOLVED, That this period of study and discussion be conducted according to the principles of conflict resolution already approved by PEC.

Resolution #26 - Delinquent Congregations

WHEREAS, the Provincial Synod of 2010 is a gathering of representatives of all the congregations of the Southern Province to deal with the affairs of the Province as seems best for the whole church; and,

WHEREAS, the Provincial Synod of 2010 has gathered at Black Mountain, NC as called by the Provincial Elders' Conference; and,

WHEREAS, we acknowledge that the Book of Order (Paragraph 1550, II. Rules and Regulations, Section 3. Representation at Synod) states that congregations which are delinquent in payment of the pastor's salary or other current expenses forfeit their entitlement to representation at Synod by their elected delegates; and,

WHEREAS, it is noted that the following congregations have salaries or other current expenses unpaid for 2009 (as of August 31, 2010 per the Office of the Provincial Treasurer):

New Hope FL (pastor's housing equity) = $7,333

Peace (pastor's housing equity, payroll, property insurance) = $59,057

WHEREAS, the pastors of these congregations are entitled to attend Synod with the privilege of both voice and vote (BOO, Paragraph 1550, II Rules and Regulations, Section 2. Members of Provincial Synods); and,

WHEREAS, it is the belief of the Provincial Elders' Conference and the Provincial Financial Board that we are a church that functions best when all congregations are represented at the table; and,

WHEREAS, it is the desire of the Provincial Elders' Conference and the Provincial Financial Board that all congregational representatives have both voice and vote in order to participate fully in the discussions and discernment of the 2010 Provincial Synod; therefore, be it

RESOLVED, That the elected delegates (as well as pastors) of the congregations of New Hope FL and Peace shall be entitled to have voice and vote during the Synod of 2010 through suspension of Paragraph 1550, Section 3. Representation at Synod of the Book of Order; and,

RESOLVED, That the amounts currently outstanding shall not be excused, but that in each case an understanding will be reached between the congregation's board(s) for the congregation to pay the outstanding amount owed to the Office of the Provincial Treasurer over a period of time; and,

RESOLVED, That the Provincial Elders' Conference shall be encouraged to utilize available provincial staff, agencies and commissions to address the health of these congregations through ministry assessment, renewal and redevelopment as may be deemed appropriate by the Provincial Elders' Conference.


Resolution #28 - Provincial Share Allocation

Subject: Provincial Share Allocation

WHEREAS, the current Book of Order, Section 1204, speaks to the methodology for allocating support from our churches (i.e. Provincial Share) for funding Provincial Ministry; and,

WHEREAS, this methodology and the size of the Provincial Budget has resulted in a Provincial Share that averages about 20% of an individual church's operating budget and in many churches has resulted in the need for relief from being able to fully support the Province; and,

WHEREAS, the Financial Ministry Group of the 2006 Synod seriously considered a change in the method of allocating the Provincial budget to churches but was unable to come to terms or agreement on how to address this; and,

WHEREAS, the Provincial Administration/Ministries Task Force recommended that a new method of developing the level of support from our churches in support of the common ministries for the Province should be developed; and,

WHEREAS, the Moravian Church in America, Northern Province at its 2010 Synod recognized the need for a better way to receive funding from each congregation for the support of Common Ministries of the Province; and,

WHEREAS, the PEC of the Northern Province has been charged by their 2010 Synod to develop and implement a new method of determining each congregation's financial commitment in support of Provincial ministries; and,

WHEREAS, the restructuring of the Southern Province provides an excellent opportunity to take advantage of increased efficiency and potentially lower costs in carrying out the mission and ministry of the Province. Much of this will be done via new Boards (the Board of Cooperative Ministries and the Provincial Support Services Board) that have yet to be fully formed; and,

WHEREAS, the new structure of the Southern Province places new responsibilities on the PEC with respect to setting the overall budget of the Province; and,

WHEREAS, the strategic direction for the Province has yet to be set by Synod and may have an impact of the financial needs of the Province or how existing resources are allocated; and,

WHEREAS, after discussion and prayerful consideration of several options that would change the way that the Provincial budget is allocated or financial resources are raised from our churches, the Finance Committee was unable to come to a consensus on making any change; therefore be it

RESOLVED, That the PEC in conjunction with the yet to be appointed Provincial Support Services Board, review, evaluate and develop a potentially new methodology for allocating the need for Provincial support from our churches; and,

RESOLVED, That any change be made after due consideration of the changes currently being considered by the PEC of the Moravian Church in America, Northern Province, in an effort to potentially unify the approach between the two Provinces; and,

RESOLVED, That if a change in the methodology for allocating the need for Provincial support is approved and implemented by the PEC within the next inter-synodal period, the current Book of Order, Section 1204, be suspended for the remaining portion of the inter-synodal period with a conforming amendment to the Book of Order that speaks to this new implemented methodology being proposed at the 2014 Synod.

Resolution #30 - Recognition of the Rev. William (Will) C. Sibert

WHEREAS, Brother Will Sibert has served as Executive Director of the Board of World Mission for the Moravian Church in America from 2004 to 2010; and,

WHEREAS, Brother Sibert's ministry has had a significant impact on mission vision, strategy and energy in the Northern and Southern Provinces and beyond; and,

WHEREAS, Brother Sibert has helped to guide the church's mission work through a period of transition and to help people see opportunities for God to do a "new thing;" and,

WHEREAS, Brother Sibert with an assembled staff of persons having diverse gifts and skills has made it possible for the Board of World Mission to connect with a greater variety of people in the church and to open doors to more areas of mission service (music, education, construction, medical, counseling and farming); therefore be it

RESOLVED, That the Synod of 2010 express the Province's gratitude for his faithful and dedicated service to Christ and His Church by rising and giving Brother Sibert a round of applause.


Resolution #31 - Recognition of the Provincial Administration/Ministries Task Force

Subject: Recognition of the Provincial Administration/Ministries Task Force

WHEREAS, Resolution #55 of the 2006 Provincial Synod called for the Provincial Elders' Conference to appoint an impartial task force charged with systematically and critically examining all aspects of Southern Province administration and ministries including PEC, boards and agencies and their relationships with local congregations; and,

WHEREAS, the Provincial Elders' Conference accepted this mandate and appointed the Task Force soon after the Synod of 2006; and,

WHEREAS, this group of diverse servants from various congregations and backgrounds, faithfully met for over 3 ½ years researching and evaluating provincial ministries; and,

WHEREAS, after prayerful work and a diligent search for God's leading, the Provincial Administration/Ministries Task Force carefully designed a plan for provincial restructure and presented it to a special Synod in August of 2009 where it was adopted; therefore be it

RESOLVED, That the Synod of 2010 express its appreciation to Powell Winstead, Chair, Cindy Arrington, Sandy Baldwin, Betsy Bombick, Gil Frank, Paul Knouse, Bill McElveen, Graham Rights, Neil Routh, Wayne Shugart and Steve Wilson for their faithful and dedicated service as members of the Provincial Administration/Ministries Task Force, Moravian Church, Southern Province.


Resolution #32 - Recognition of Mr. Robert (Bob) Hunter

Subject: Recognition of Mr. Robert (Bob) Hunter

WHEREAS, Robert (Bob) Hunter has faithfully served as Assistant to the President of the Provincial Elders' Conference since 1998 with integrity, wisdom, and true Christian grace; and,

WHEREAS, Brother Hunter has served the Provincial Elders' Conference and its President by working with candidates for ordained ministry, advising and supporting local church boards in time of congregational reviews, call processes and conflicts; and,

WHEREAS, Brother Hunter has served as counselor, friend and coach to pastors, seminary students, and many others through his compassionate care, warmth, honesty, and genuine good nature and humor; and,

WHEREAS, Brother Hunter has, during some of the province's most challenging times, been a steadying influence and guide to all; and,

WHEREAS, Brother Hunter will conclude his time of service with his official retirement on September 30, 2010, and, with his wife Sarah, completes a time of faithful service to the Moravian Church, Southern Province; therefore be it

RESOVED, That the Synod of 2010 rise and give Brother Bob Hunter a round of applause as an expression of this Province's gratitude for his dedicated service to Christ, our Chief Elder.


Resolution #33 - Recognition of the Rt. Rev. Dr. D. Wayne Burkette

WHEREAS, Bishop D. Wayne Burkette has faithfully served as the President of the Provincial Elders' Conference for the past 4 ½ years; and,

WHEREAS, Brother Burkette has been an excellent administrator of our Province, giving himself tirelessly to the challenging ministry of leadership; and,

WHEREAS, Brother Burkette has led our church effectively through a time of restructure, change and transition; and,

WHEREAS, Brother Burkette has served the Moravian Church, Southern Province for over 40 years as a pastor, educator, PEC member, bishop and administrator; and,

WHEREAS, Brother Burkette truly exemplifies the spirit of the Moravian Church in both life and ministry; therefore be it

RESOLVED, That the Synod of 2010 visibly express the Province's gratitude for his faithful and dedicated service to Christ and His Church by rising and giving Brother Burkette a round of applause.


Resolution #34 - Strategic Direction for the Province

WHEREAS, the Synod of 2010 of the Moravian Church in America, Southern Province, has included, as part of its work, strategic planning to guide the direction of the Province during the next four-year intersynodal period; and,

WHEREAS, Synod delegates participating in the Covenant Partner Groups have worked diligently to discern the will of Christ, followed the leading of the Holy Spirit, and developed a strategic vision and priorities for our Province; and,

WHEREAS, the recommendations and reports of the Covenant Partner Groups, including Priority Initiatives and Directional Statements, were presented to the Synod of 2010 at the September 11th afternoon Plenary Session; therefore be it

RESOLVED, That the Synod of 2010 acknowledges the value of the strategic planning process undertaken by the Covenant Partner Groups and expresses its appreciation for the efforts of the facilitators, recorders and all participants in this process; and,

RESOLVED, That the Synod of 2010 adopts the reports of the Covenant Partner Groups and forwards them to the Provincial Elders' Conference as a strategic vision to guide the Moravian Church in America, Southern Province, during the next intersynodal period.
